7. Application
If the Ringtones or Screen Savers have not been successfully downloaded within 24 hours of completion of your purchase, please notify us not more than 7 days later by email. If you fail to notify us within that period, you will be conclusively presumed to have received the Ringtones or Screen Savers. If you do notify us within that period, we shall attempt to download the Ringtones or Screen Savers for a further 24 hours after your notification, but if downloading is not achieved within that period it will be assumed that downloading is not possible.

8. Notification
These terms apply to any arrangement (referred to as the "Contract") for downloading mobile telephone Ringtones or Screen Savers via the www.ringtones.com Website (referred to as "the Website"). The Contract is made between (1) the Customer (referred to as "You" or "Your") who downloads (or seeks to download) one or more selected Ringtones or Screen Savers and (2) Mobile Streams as operators of the Website (referred to as "We" "Us" or "Our").

9. Copyright Restrictions
The Contract constitutes a permanent non-exclusive license to use the Ringtones or Screen Savers. The License is personal to you and you must not transfer the content to any other person or persons. To do so will constitute a breach of copyright for which you may be liable to pay compensation and costs.

10. Warranties and Limitations on our Liability

We warrant that:

• Once downloaded, the Ringtones, Screen Savers and Games will operate indefinitely or until removed by you or a person to whom you have given access to the mobile telephone to which the Ringtones, Screen Savers or Games were delivered.

• We are entitled to license you to use the Ringtones, Screen Savers and Games for use on your mobile telephone and that no third party will take action against you in respect of that use.

• The message used to deliver the Ringtones, Screen Savers or Games will not introduce any virus on to your mobile phone and our liability under theabove warranties shall be without limit

• We shall be liable without limit for any death or injury to any person caused by our own negligence or that of our employees agents or sub-contractors

• Save as expressly set out above, all warranties representations conditions or other terms of whatever nature, whether expressed or implied, and however arising, in relation to the Ringtones or the Contract are hereby limited and excluded to the maximum extent permitted by law and in particular

• Because you have chosen the Ringtones, Screen Savers or Games and have had an opportunity of checking them prior to purchase, we accept no liability if the Ringtones, Screen Savers or Games that are in any way found to be of unsatisfactory quality or otherwise not suitable for your purpose.

• We are not liable for any oral or written statement or representation as to the Ringtones, Screen Savers or Games or their suitability for any particular purpose.

• We shall be under no liability whatsoever (and hereby exclude liability) for any indirect or consequential loss damage cost or expense of any kind whatever and however caused, whether arising under contract, tort (including negligence) or otherwise including (without limitation) loss of business, earnings, profits or contracts even if we have been advised in advance of the possibility of such damage

• We shall not be liable in any circumstances for any loss damage injury or delay due to circumstances or any cause beyond our control in relation to the Ringtones, Screen Savers or Games or the performance of our obligations under the Contract.

11. Complaints
Your satisfaction is important to us. If you are in any way dissatisfied with the service you receive or have any suggestions as to how that service might be improved, please contact us by email. We will then investigate the matter thoroughly and take whatever action we think appropriate.

12. Third Parties
We do not intend to confer any benefit on any person other than the persons using our service in accordance with these terms of business and we do not intend that any term of any contract made pursuant to these terms of business should be enforceable by anyone other than those persons.

13. Applicable Law
The Contract and these Terms of Business shall be governed in all respects by, and construed in accordance with US Law and shall be subject to the non-exclusive jurisdiction of the US Courts.
